It sounds like the Ryan Widmer case is going to be appealed until he dies in jail, or gets released.  In my personal non legal professional opinion, America has gotten to the point that if a prosecutor wants to win a case, then he or she will.  It is simple.  They will continue to drain the resources of a defendant at all costs to the taxpayers, the unlimited funds, and the defendant will simply run out of money.  If the prosecution doesn’t happen to win, they will simply retry the case.

In this “everyone is guilty” world we live in, it is simply unreal how people that sit on juries can make up their minds for cases prior to seeing any evidence. We are now “one nation under drugs” since the average American takes over 10 prescription pills now in my opinion (actually saw this statistic but can’t remember where so I am saying it is just my opinion).  So is it possible that his wife was just another victim of prescription overdose?   How did the toxicology report come out?  Did the defense get one?

I am not saying the defense was not solid, but it sure does make me wonder if he was 100% innocent, would it really matter?  The prosecutor was 100% committed to getting a conviction, regardless of what little evidence there actually was.  It just seems that in my opinion, in America you are guilty until proven innocent now, and you are only able to be innocent if you happen to have a lower profile case that stays out of the news. If it is in the news, then it seems you simply will struggle to get a fair trial since the prosecutor’s political reputation is at stake.  Thankfully Hamilton County’s Joe Deters seems to care more about doing a good job than putting everyone in jail.  When the gentleman in Cincinnati shot someone in self defense, he did not turn it into a media spectacle.  He simply said no charges and let it be over with.

I am curious what others think about the Ryan Widmer case.  Obviously he will never get another day in court, the “res judicata” or some other legal argument will keep him out of court forever, in my opinion.  Plus, he will never have any money since he was drained by the 4 cases already financially.  I still wonder if he will be able to file a motion to vacate a void judgment, if he will take it upon himself in all those years behind bars to actually study the rules of criminal procedure and rules of evidence, and find the magic in the case that makes his a void judgment.  In all my years of legal research, I have yet to see even one civil case where a plaintiff did everything right and there were no mistakes which could make the judgment void.  Since this is criminal, it could be more difficult and since it went to trial, that makes it even more difficult. But if I was Widmer, I would study the Bible most of the time for what is really the most important thing, getting saved and readying himself for salvation.  Then, I would spend some time in the Ohio Rules of Criminal Procedure and the Ohio Rules of Evidence for 2 years straight for at least 10 hours a week.  By that time, he should have the knowledge of any prosecutor or judge in Ohio and then some as it pertains to procedural issues.  This is his best shot in my opinion.   What are you thoughts?

It is important that you ensure you get the right kind of lawyer for your particular circumstances, as using a lawyer who knows a little about a lot of laws will not going be as beneficial to you as finding one who concentrates on one or two specific ones. If you have been charged with assault you will need a Cincinnati Assault Lawyer, also known as criminal defense attorney to represent you in court. This is in direct contrast to a Cincinnati personal injury lawyer or Cincinnati civil assault lawyer who will take your case to claim damages for you or recoup any financial losses due to the result of an assault against you.

In cases where it is no longer possible for a person to work due to disability it may be the case that a Cincinnati Disability Coverage Lawyer is needed; individuals unable to work due to a disability will typically claim money from Social Security, but if this is not possible or if their claim is refused a Cincinnati disability lawyer will help them to appeal or re-claim if necessary. Cincinnati long term disability lawyers will be able to help if you find that you are having problems with insurance companies, labor laws and your legal rights.

The last thing you want is for your will to be contested because it was not done correctly or because of spelling mistakes or errors etc. Cincinnati probate lawyers will represent you in the case of your death if there are any discrepancies or if your will is contested, but an estate planning lawyer can prevent things going this far.

Attorney Cincinnati – Credit where Credit’s due

More and more people are finding themselves in debt and unable to get out of it. This could be attributed to various reasons, but whatever that reason may be hiring a good Cincinnati credit lawyer is crucial in making the right steps towards a debt-free future. Both are well versed in the laws of the road, but they deal with distinctly different aspects of them. A DWI lawyer will be the one to choose in regards to charges of being drunk while intoxicated while a DUI lawyer will deal with drunk under the influence charges.

If you are involved in a road accident you should hire a Cincinnati car accident lawyer, and it is even possible to find Cincinnati boating accident lawyers for those who have been involved in an accident or broken the law while on the water. Whatever your vehicle charge, make sure you find a Cincinnati attorney who suits your individual needs.  Back to Attorney Cincinnati.

In Cincinnati, Ohio, you can go up and down Main St. or Vine St. and find more Cincinnati law offices than any other type of business.  Clearly there is a need in Cincinnati, Ohio for a lot of lawyers and therefore we are here to help you decide which Cincinnati law firm you should select.

It is best to ask a lot of questions when evaluating a Cincinnati law firm since you are likely going to be spending a lot of money on a retainer fee.  Whether you are involved in a personal injury or need a divorce attorney, or anything in between, you will need to find the best Cincinnati law firm for your needs.

Asking lots of questions of your potential Cincinnati attorney will allow you to be comfortable with the potential resolutions he or she gives you and you will get a clearer picture of possible outcomes of your situation.  Simply calling up the first Cincinnati law office you see on a billboard is not likely going to get you the best outcome in court or out of court.

Cincinnati Law Firms and Reasonable Expectations

When consulting with a Cincinnati lawyer, be sure to give your attorney as much information as possible and also work with your attorney in a reasonable way.  Do not expect miracles from them just because they pay more in rent than any other Cincinnati law firm.  Have reasonable expectations and be sure you are comfortable with them before making a decision.

Sometimes you will need to check out more than one Cincinnati law firm before deciding on the best for your personal injury claim, or bankruptcy case, or even civil defense case.  Whether your matter is criminal or civil, going into court without an attorney is very risky.  Interview differnet Cincinnati law firm offices and make phone calls and search until you have found the very best for your situation.  Here at our Attorney Cincinnati blog we only recommend excellent attorneys who are professional, courteous, have reasonable fees, and provide value to their customers.

Oftentimes we think something might not be relevant to the case or that the attorney will not need to know.  It is best to divulge everything so your attorney can make a smart business decision based on all the facts as to whether or not to take a deal.  Attorneys more often than not can make a determination how to proceed once they have complete information.

Cincinnati Lawyer – What Can hiring a good attorney in Cincinnati do for me?

Perhaps you have been arrested on criminal charges like a DUI or possibly are in need of an attorney in Cincinnati for a civil defense case.  Maybe you are going to be a plaintiff and need to sue someone and need to hire a Cincinnati lawyer.  Whatever the reason, there are many reasons why you will want to hire an attorney in Cincinnati before you walk into the common pleas or municipal courts or do any type of contract.

Some Pointed Reasons for Hiring a Cincinnati Lawyer

One of the biggest reasons to hire a Cincinnati lawyer before going to court is for peace of mind.  Having a Cincinnati lawyer to represent you in a court case will bring your chances of a favorable outcome way up.  From knowing the rules of the court to being experienced in oral argument, an attorney will help your chances of winning.  It happens all the time to people who try to go in to court alone, they walk out saying to themselves, “I probably should have used an attorney.”

Another good reason to use a Cincinnati lawyer is so that you will not be alone in court.  If you have never been in court as a defendant then you will not understand the magnitude of why you should walk in with a Cincinnati lawyer to all the Cincinnati and surrounding area courts.  There will be lots of sheriff deputies and bailiffs with guns surrounding you in the courtroom.  There is a judge that is put up several feet so he can be looking down at you.  In a criminal case, they also will have multiple prosecutors in suits in there.  It seems like it is 20 against 1 and can be very intimidating regardless of how right you think you are, or how much procedure or evidence you may know.  It can be intimidating and lonely so I highly recommend hiring a Cincinnati lawyer before going into court.

Sometimes it can be more expensive not to hire a Cincinnati lawyer.  Some people say that the fees they pay accountants actually save them money since their accountant is able to work their tax return in a manner they could not have done for themselves and it has saved them far more than the fees.  It can work the same way with your Cincinnati lawyer.  When you retain a Cincinnati attorney then you can have peace of mind that the worse is likely not going to happen.  Not having good legal counsel could cost you thousands in certain types of dealings yet a good attorney will make sure that does not happen to you for an initial fee upfront.

I have heard stories of people who thought all they have to do is hear my side of the story and it will be fine, I don’t need an attorney.  Well, what is interesting about that is that oftentimes those people end up in jail or losing a massive amount of money in a civil court.  Regardless of how right you think you are or anything else, it just seems to me, in my personal opinion, having a Cincinnati lawyer in court makes the court act differently as opposed to pro se litigant Cincinnati Lawyerpleadings, both oral and in writing.  For whatever reason, in my personal opinion, courts do not read the pleadings of pro se litigants and do not treat them fairly, despite what they claim. This is why you must hire a Cincinnati lawyer to represent you.

Cincinnati Lawyer – Contract and Written Documents

Perhaps you need some sort of contract drawn up or are going to be selling a business or doing some sort of real estate transaction.  I have seen people lose thousands upon thousands of dollars because they tried to use a template or figured there was nothing in the contract that was negative or anything like that.  The problem is that words in a legal sense mean something different many times than they mean in a legal document.  Go to the law library or a bookstore and pick up Blacks Law Dictionary and just look at some common words in there.  You will be surprised at the meaning of some words that will surprise you.  This is why anytime you are dealing with written documents and transacting business, you should hire a Cincinnati lawyer to assist you.

Bankruptcy is another thing that some people try and do on their own with all the new online resources for self filing.  This is yet another major mistake people make since they are interviewed by a trustee and under oath.  When dealing with bankruptcy you should always hire a Cincinnati lawyer to represent you.  Just because all the paperwork is in order by yourself does not mean you are prepared for the interview under oath and anything else that might come up.  It is highly recommended to consult with a Cincinnati bankruptcy attorney if you are considering filing bankruptcy.   There are so many things that could happen in a courtroom that when doing something as significant as filing bankruptcy, you should hire a Cincinnati lawyer to represent you in the United States Southern District Court of Ohio.

Whatever the reason, be it bankruptcy, real estate, wills, DUI, criminal or civil, be sure to seek a Cincinnati lawyer for legal services.  It will cost you something but more than likely be a lot less expensive than the consequences of not having the legal expertise at your side representing you.  Again, don’t become a horror story of someone who tried to be a legal superstar and got spanked by the judge, go hire a Cincinnati lawyer.

Cincinnati Attorney – What can a criminal attorney do for you?

If you find yourself with any sort of criminal problem, be it a driving under the influence (DUI) or something as serious as a felony, you will most likely want to talk to a Cincinnati attorney as soon as possible.  In criminal cases, there is a clock that ticks very fast from the time you are charged and arraigned until the time you have until trial due to the speedy trial clause.

Once you plead either not guilty or no contest, the clock starts ticking very fast in which you have to answer the charges and start making motions and also requests for discovery motions with the prosecutor.  It has been the experience of most pro se litigants that understanding and knowing the Ohio Rules of Criminal Procedure are too extensive and difficult to know well enough to win their case.  This is the reason most people end up retaining a Cincinnati attorney for their case in Ohio’s courts.

Can a Cincinnati Attorney Change the Outcome of Your Case?

Using a Cincinnati attorney will increase the likelihood of a favorable outcome.  Of course more than likely in most cases there will be a settlement or deal with the prosecutor, especially in light of the shortage of jail space in Hamilton, Butler, and Warren County jails.  Since most cases never reach an actual trial, using a Cincinnati attorney is a good idea since they will be able to negotiate with the prosecution as well as have a deep understanding of the Ohio Criminal Procedure rules as well as how they apply to each particular case.

Finding a good Cincinnati attorney if you don’t have any money can be about impossible though if you qualify according to the court’s standard, you can be appointed a public defender.  This is of course not as good of an option as hiring your own private Cincinnati attorney since most public defenders are so overworked they have little time to spend on your case.  When hiring your own Cincinnati attorney they will work as many hours as you have dollars, thereby getting as good a case built as possible to get the case dismissed or at least get to a favorable negotiating position for a deal to take place.

Discussing Your Criminal Case With a Cincinnati Attorney

When you discuss your case with a Cincinnati attorney, keep in mind that he needs to know all the details about what may have happened.  Ask your attorney if there is privilege in your communication, and once he or she verifies there is, then you can start telling him/her everything regardless of whether you think it will help or not.  Of course however they lead the conversation is fine, but if your Cincinnati attorney asks you questions, be honest and truthful and complete so they know how to proceed and are not surprised later.  In fact, if you see the movie “The Lincoln Lawyer”, you will know what I mean.  What a great movie, by the way – highly recommend it!

When you take your case to a Cincinnati attorney, be sure to ask him what your options are.  Depending on the case the prosecutor has and the evidence that is out there, it may be a simple or a difficult case.  Further, the case may be a tougher one to prosecute and possibly require a lot of work out of the prosecutor.  In these cases, a deal can be reached much faster which saves the prosecutor’s office time and the county money.  Using this to your advantage you can get a faster resolution if you are willing to take a deal.  Talk to you Cincinnati attorney and be sure to indicate to him what you can or cannot do and what you are willing to take in terms of a deal, be it fines, jail time, probation, community service, and everything else.

If you are willing to do community service and/or make restitution that will sometimes be enough to get a deal done.  Be sure to indicate to your Cincinnati attorney if that is reasonable.  Using a Cincinnati attorney is a good idea too since he/she will know the judges and their tendencies from prior cases.  I can’t state this enough, many times the attorneys biggest benefit is their knowledge of the judges and their personalities, their decision making tendencies, and the Cincinnati Attorneyprocedures in different courtrooms.  Though the Ohio Rules of Criminal Procedure dictate the procedural rules for Ohio courts, the local county also has courtroom rules.  Further, judges tend to expect different things from attorneys and this is where a pro se litigant is behind the game from the beginning.

Even though you may be a student of the law and know the Ohio Rules of Criminal Procedure and the Ohio Rules of Evidence better than your Cincinnati attorney, it is advisable to hire a Cincinnati attorney since the court sometimes does not follow procedure and this could throw you off.  Yes, even though they are supposed to follow the rules of procedure and this could be how you win your case, as a pro se litigant the judges will likely not take you seriously and you will then have to appeal your case.  Pro Se litigants do win rarely and also win rarely on appeal, and despite that they might be following the rules of procedure precisely, it may not be enough “error” to win on appeal anyways.  So regardless of how good of knowledge you have on procedure, hire a Cincinnati attorney and use your knowledge to keep up with your case and double check your attorney’s work since they are busy and occasionally make mistakes.

Lastly, hiring a Cincinnati attorney can give you peace of mind that you will not have to know the court’s rules and not have to get into oral argument with the prosecutor.  There are so many things that can happen in a criminal case that I can never imaging going in without a Cincinnati lawyer.  Despite what jailhouse lawyers and movies show, a completely different picture is reality when you walk into Ohio’s courts.  From the numerous county employees in suits, bailiffs with guns, deputy sheriff’s surrounding, you – it can be quite intimidating looking up at the judge on his “pedestal” with his team of gun toting county employees surrounding you.  It can be extremely intimidating even if you are more knowledgeable in the law than the judge and prosecution.  For this reason and many others, keep things simple if you want and  go hire a Cincinnati attorney who knows criminal defense very well.  If you are considering filing bankruptcy, consult a Cincinnati bankruptcy attorney.

Hopefully this blog about why to hire a Cincinnati attorney has been helpful.
